Abstract:

Credit likes to be secured and security seems to never be enough. Not only are there more parties demanding security rights than ever, also the scope of secured credit has increased significantly over the last 25 years. The combined effect is that there is very little left to be divided among unsecured creditors. This conference discusses the future of secured credit. Key note speaker is professor Jesse Fried, co-author of the seminal article 'The Uneasy Case for the Priority of Secured Claims in Bankruptcy'. His proposal for partial priority will be compared with the Insolad Proposal for a prescribed part, leaving a percentage of encumbered assets for unsecured creditors. Furthermore, Dutch law on the enforcement of security rights will be compared with other legal systems.
